Welcome to Stay in Hobart eDirectory. These Terms & Conditions (“Terms”) apply to all visitors, users, reviewers, and businesses who access or use the Stay in Hobart website (“Website”, “Directory”, “we”, “us”, “our”).

By using the Website, submitting a review, creating an account, or purchasing a listing or featured placement, you agree to be bound by these Terms.

1. About Us

Stay in Hobart operates an online directory listing accommodation providers, tourism operators, services, attractions, and other businesses in Hobart and Tasmania.

We provide information supplied by businesses and users and make it available for public browsing.

2. Acceptance of Terms

By accessing or using the Directory, you agree to be bound by these Terms.

If you create an account, submit content, or purchase a listing, you acknowledge these Terms apply to you.

We may update these Terms at any time by posting a revised version on the Website. Continued use after revisions constitutes acceptance.

3. Directory Service Description

Stay in Hobart provides an information directory only.

We do not:

  • verify all information supplied by businesses or users guarantee the accuracy, timeliness or completeness of listings endorse any business participate in or become a party to transactions between users and businesses

4. Business Listings (Free and Paid)

4.1 Free Listings

Free listings may include a basic profile.

We may edit, restrict, remove or decline free listings at our discretion.

No guaranteed visibility or ranking is provided for free listings.

4.2 Paid Listings

Paid listings provide additional or enhanced features as described at the time of purchase.

We control formatting, layout, and design to ensure consistency.

Businesses must ensure all information is lawful, accurate and not misleading.

4.3 Featured Placement

Featured placement increases visibility only.

We make no guarantee regarding search ranking stability, traffic, leads, enquiries, or bookings — consistent with recommended limitations of liability for business listings.

Featured placement may rotate or change based on site updates, device layout, or algorithmic sorting.

5. Business Customer Obligations

Business Customers warrant that:

all supplied content (including images, logos, text) is accurate and lawful they own or are licensed to use all content listings comply with Australian law, including the prohibition on misleading or deceptive conduct (as required under ACL).

Businesses indemnify us for any claims arising from their listing content, conduct, or breach of these Terms. Indemnity is a common and enforceable mechanism for managing risk.

6. Payments, Renewals & Refunds

Fees are clearly displayed at the time of purchase.

Unless otherwise stated, paid listings renew automatically until cancelled.

Refunds

Refunds must comply with Australian Consumer Law. ACL prohibits blanket “no refunds” policies and requires clear disclosure of when refunds apply.

Except as required by law, fees already paid for live listing periods or featured placement are non‑refundable once services have commenced.

7. User Accounts

Users are responsible for maintaining the security of their login credentials.

We may suspend or terminate accounts that breach these Terms, submit harmful content, or attempt to undermine the Website’s functionality.

8. Reviews & User‑Generated Content (UGC)

8.1 User Responsibilities

Users may submit reviews, ratings, comments, photos or other content (“User Content”).

You must not submit content that is:

  • defamatory
  • misleading or false
  • harassing, abusive or hateful
  • promotional or incentivised
  • infringing copyright or other rights
  • containing personal information about other individuals without consent

These restrictions reflect recognised UGC risks including defamation, copyright infringement and misleading conduct.

8.2 Moderation Rights

We may remove, edit or disable User Content at our discretion, including upon receiving complaints.

8.3 Licence Granted to Us

By submitting User Content, you grant Stay in Hobart a non‑exclusive, worldwide, royalty‑free licence to use, reproduce, publish and display that content on the Directory and for promotional purposes.

8.4 Reviews Disclaimer

Reviews are the opinions of users and are not verified or endorsed by us.

9. Communications Between Users and Businesses

The Directory may provide click‑to‑call and click‑to‑email features.

We act purely as a conduit for these interactions and are not responsible for:

  • the content of communications
  • the timeliness of responses
  • the outcomes of interactions

10. Intellectual Property

The Website design, structure, content and database are owned by us.

Businesses and users retain ownership of their own submitted content but grant us the licence described in Section 8.3.

You may not copy, scrape, reproduce or redistribute Directory data without permission.

11. Prohibited Uses

You must not:

  • scrape or harvest Directory data
  • use automated systems or bots
  • impersonate others
  • upload malicious code
  • interfere with the Website’s security
  • create fake reviews or manipulate ratings
  • attempt to bypass paid listing or featured placement structures

12. Suspension or Termination

We may suspend or terminate user accounts, remove listings, or revoke access where:

  • Terms are violated
  • unlawful or harmful content is identified
  • required by law or regulator

We may also remove inactive business listings at our discretion.

13. Limitation of Liability

To the extent permitted by law, we exclude liability for:

  • indirect or consequential loss
  • loss of profits, revenue, goodwill, or data
  • loss arising from business decisions made based on Directory content

Liability caps and reasonable exclusions are recognised mechanisms for managing risk, but must be consistent with ACL and fairness requirements.

Nothing in these Terms excludes rights and consumer guarantees under the Australian Consumer Law that cannot be excluded.

Where liability cannot be excluded, our total liability is limited (at our election) to re‑supplying services or the cost of re‑supplying them.

14. Privacy

Our Privacy Policy explains how we collect, store, use and disclose personal information.

A publicly available privacy policy is required under Australian Privacy Principles for transparent personal information management.
