Guest Terms and Conditions
1. Definitions
Accommodation: The property booked by the Guest.
Guest: The person making the booking and every authorised occupant.
Manager: Holiday Rental Hosting Pty Ltd acting on behalf of the Owner.
Owner: The registered owner of the Accommodation.
Booking: The confirmed reservation issued by Holiday Rental Hosting.
Damage Waiver: The protection product purchased through TRUVI or another approved provider.
2. Booking Agreement
Holiday Rental Hosting Pty Ltd acts as the authorised booking and management agent for the Owner of the Accommodation. A booking becomes legally binding only after written confirmation has been issued by Holiday Rental Hosting.
The Guest is granted a temporary licence to occupy the Accommodation for holiday or short-term accommodation purposes only. This Agreement does not create a residential tenancy or confer exclusive possession.
The person making the booking warrants that they are at least 18 years of age and are authorised to accept these Terms and Conditions on behalf of every Guest included in the booking.
Electronic acceptance of these Terms, payment of any deposit, or occupation of the Accommodation constitutes acceptance of this Agreement.
- Booking & Payment Terms
3.1 Booking Confirmation
Bookings are not confirmed until Holiday Rental Hosting has received the required payment, guest verification has been completed (where required), and written confirmation has been issued by email.
3.2 Deposit
A non-refundable deposit equal to 51% of the total booking amount is payable within 24 hours of making the booking unless otherwise agreed in writing.
3.3 Balance Payment
The remaining 49% of the booking amount is payable no later than seven (7) days before arrival. Reservations made within seven days of arrival require full payment at the time of booking.
3.4 Payment Methods
Payments may be made using Stripe or other approved payment providers. All payments are processed in Australian Dollars (AUD) and include GST where applicable.
3.5 Guest Verification
Guests must complete identity verification through TRUVI (formerly Superhog) or another approved provider and purchase the required Damage Waiver or provide any required security deposit.
3.6 Failure to Pay
Failure to make payment by the due date may result in cancellation of the booking without further notice. Holiday Rental Hosting may re-let the property.
3.7 Pricing Errors
Holiday Rental Hosting reserves the right to correct genuine pricing or typographical errors before booking confirmation. Where applicable, the Guest may accept the revised price or receive a full refund.
3.8 Third-Party Bookings
Bookings made through Airbnb, Booking.com, Stayz or similar platforms remain subject to the payment and cancellation rules of those platforms where they differ from these Terms.
3.9 Fraud Prevention
Holiday Rental Hosting may cancel bookings where fraudulent payment, identity theft, chargeback abuse or other suspicious activity is reasonably suspected and may provide information to payment processors, insurers or authorities where permitted by law.
- Cancellation Policy
4.1 Cooling-Off Period
Guests booking directly with Holiday Rental Hosting may cancel within 24 hours of making the booking for a full refund, provided the scheduled arrival date is more than 21 days away.
4.2 Standard Cancellation
If a booking is cancelled more than 21 days before arrival, any refund will be determined in accordance with the booking confirmation and applicable rate conditions.
4.3 Cancellation Within 21 Days
If a Guest cancels within 21 days of arrival, the 51% deposit is non-refundable. Any remaining monies paid will be refunded only if the Accommodation is re-let for the same period and at the same or greater value, less any administration and payment processing fees.
4.4 No Show
Guests who fail to arrive without prior written notice will forfeit the total booking amount.
4.5 Amendments
Requests to amend dates are subject to availability and are not guaranteed. Approved amendments may incur additional charges where nightly rates or minimum stay requirements differ.
4.6 Travel Insurance
Guests are strongly encouraged to obtain comprehensive travel insurance to cover cancellations, illness, transport disruption and other unforeseen events.
4.7 Owner Cancellation
If the Owner or Holiday Rental Hosting is required to cancel a booking due to circumstances beyond reasonable control, all monies paid will be refunded in full. Holiday Rental Hosting may assist in locating suitable alternative accommodation but does not guarantee availability.
- Check-in & Check-out
5.1 Standard Times
Check-in is from 2:00 pm unless otherwise confirmed in writing. Check-out is by 10:00 am on the departure date.
5.2 Early Check-in / Late Check-out
Early check-in or late check-out is available only with prior written approval and may incur an additional fee.
5.3 Keys and Access
Guests must follow the access instructions supplied before arrival. Keys, remotes, access cards and lockbox codes must not be copied, shared with unauthorized persons or retained after departure.
5.4 Lost Keys
Guests are responsible for the cost of replacement keys, remotes, lock barrels or locksmith attendance where access devices are lost, damaged or not returned.
5.5 Late Departure
Unauthorized late departures may incur additional accommodation charges, cleaning costs and any losses arising from delayed access for incoming guests.
5.6 Emergency Call-Outs
Non-emergency after-hours call-outs requested by Guests may incur a service fee of up to AUD $100 plus any contractor charges.
- Guest Responsibilities
6.1 Occupancy
Only the Guests listed on the booking confirmation may stay at the Accommodation unless prior written approval has been obtained.
6.2 Maximum Occupancy
The maximum number of occupants stated in the listing or booking confirmation must not be exceeded at any time.
6.3 Care of the Property
Guests must keep the Accommodation clean, secure and in substantially the same condition as it was found, allowing for fair wear and tear.
6.4 Reporting Damage
Any loss, breakage, maintenance issue or damage must be reported as soon as practicable, even if accidental.
6.5 Compliance
Guests must comply with all directions issued by Holiday Rental Hosting, applicable strata by-laws and local laws.
- House Rules
7.1 Parties and Events
Parties, events, schoolies gatherings and functions are strictly prohibited unless expressly approved in writing. Breaches may result in immediate termination without refund.
7.2 Noise
Guests must respect neighbours at all times. Quiet hours apply from 10:00 pm to 8:00 am.
7.3 Visitors
Visitors are permitted only with prior approval where required and must not cause the maximum occupancy to be exceeded.
7.4 Smoking and Vaping
Smoking and vaping are prohibited inside the Accommodation. Evidence of indoor smoking may incur specialised cleaning charges.
7.5 Pets
Pets are not permitted unless specifically approved in writing. Approved pets remain the Guest’s responsibility at all times.
7.6 BBQ
Where a BBQ is provided it must be cleaned after use. A cleaning fee may apply if left excessively dirty.
7.7 Furniture
Indoor furniture must not be moved outside. Furniture is not to be rearranged without approval.
7.8 Rubbish
Guests must place rubbish in the appropriate bins and use recycling facilities where provided. Excess rubbish may incur removal fees.
7.9 Parking
Vehicles must only be parked in designated areas. No caravans, boats or trailers are permitted without approval.
7.10 Locked Areas
Cupboards, garages, storage areas and owner cupboards marked as private must not be accessed.
7.11 Internet
Complimentary Wi-Fi is provided as a convenience only. Availability and speeds cannot be guaranteed and no compensation is payable for interruptions.
7.12 CCTV
Where external security cameras are installed they are used solely for security purposes and do not monitor internal living areas.
7.13 Electric Vehicle Charging
Charging electric vehicles from standard household power outlets is prohibited unless specifically authorised by Holiday Rental Hosting.
7.14 Illegal Activity
Illegal or anti-social behaviour is strictly prohibited and may result in immediate eviction and notification of relevant authorities.
- Property Damage, Damage Waiver & Security
8.1 Guest Responsibility
Guests are responsible for any loss, damage, excessive cleaning, theft, missing items or costs arising from their actions or the actions of any person they invite to the Accommodation.
8.2 Damage Reporting
Any accidental damage, breakage or maintenance issue must be reported to Holiday Rental Hosting as soon as reasonably practicable. Prompt reporting will always be considered when assessing liability.
8.3 TRUVI Guest Verification
Holiday Rental Hosting partners with TRUVI (formerly Superhog) to verify guest identity and, where applicable, provide a Damage Waiver. Completion of the verification process is a condition of the booking.
8.4 Damage Waiver
The Damage Waiver provides limited protection for accidental damage only and does not cover intentional damage, theft, negligence, excessive cleaning, missing items, unauthorised guests, parties or breaches of these Terms and Conditions.
8.5 Security Deposit
Certain properties may require a refundable security deposit or credit card pre-authorisation. The amount will be advised before confirmation of the booking.
8.6 Additional Charges
Holiday Rental Hosting may recover reasonable costs including repairs, replacement of damaged or missing items, locksmith attendance, specialist cleaning, rubbish removal, smoking remediation, call-out fees and loss of income where the property cannot be re-let due to Guest damage.
- Chargebacks & Payment Fraud
9.1 Authorisation
By making a booking, the Guest authorises Holiday Rental Hosting to use booking records, payment records, identity verification, communications, photographs and other evidence to dispute fraudulent chargebacks.
9.2 Fraudulent Chargebacks
If a Guest initiates an unjustified payment reversal or chargeback after occupying the Accommodation, Holiday Rental Hosting reserves the right to recover all outstanding amounts together with reasonable recovery costs.
9.3 False Identity
Holiday Rental Hosting may immediately cancel a booking without refund where false identification, stolen payment credentials or other fraudulent conduct is reasonably suspected.
9.4 Reporting
Holiday Rental Hosting may report suspected fraud to payment providers, insurers, debt recovery agencies and law enforcement authorities where permitted by law.
- Liability & Indemnity
10.1 Limitation of Liability
Nothing in these Terms excludes, restricts or modifies any rights that cannot lawfully be excluded under the Australian Consumer Law.
10.2 Guest Indemnity
To the extent permitted by law, the Guest indemnifies the Owner and Holiday Rental Hosting against claims, losses, liabilities, costs and expenses arising from the Guest’s breach of these Terms or negligent or unlawful conduct.
10.3 Personal Property
Guests are responsible for their own personal belongings. Holiday Rental Hosting and the Owner accept no responsibility for loss, theft or damage unless caused by their negligence.
10.4 Recreational Facilities
Pools, spas, kayaks, fireplaces, bicycles, gyms, sporting equipment and similar facilities are used entirely at the Guest’s own risk unless otherwise required by law.
10.5 Insurance
Guests are strongly encouraged to maintain appropriate travel and personal property insurance for the duration of their stay.
- Privacy
11.1 Collection of Information
Holiday Rental Hosting collects personal information necessary to process bookings, verify identity, manage guest stays, comply with legal obligations and protect the Accommodation.
11.2 Disclosure
Personal information may be disclosed to Owners, payment providers, TRUVI, maintenance contractors, insurers, booking platforms and government authorities where reasonably required or authorised by law.
11.3 Security
Holiday Rental Hosting takes reasonable steps to protect personal information against misuse, interference, unauthorised access, modification and disclosure.
11.4 Privacy Legislation
Personal information will be handled in accordance with the Privacy Act 1988 (Cth), the Australian Privacy Principles and any other applicable privacy legislation.
11.5 Marketing
Guests may receive occasional marketing communications. Guests may opt out of marketing communications at any time.
- Australian Consumer Law
12.1 Statutory Rights
Nothing in these Terms & Conditions excludes, restricts or modifies any consumer guarantees, rights or remedies that cannot lawfully be excluded under the Australian Consumer Law.
12.2 Limitation
Where permitted by law, Holiday Rental Hosting’s liability for any failure to comply with a statutory guarantee is limited to supplying the services again or paying the reasonable cost of having the services supplied again.
12.3 Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
- General Terms
13.1 Force Majeure
Holiday Rental Hosting and the Owner will not be liable for delays, cancellations or failure to perform obligations caused by events beyond their reasonable control, including natural disasters, severe weather, bushfires, floods, pandemics, government restrictions, utility failures or industrial action.
13.2 Lost Property
Items left behind will be retained for up to 14 days where practical. Collection and postage are at the Guest’s expense. Unclaimed items may be donated, recycled or disposed of after this period.
13.3 Governing Law
These Terms & Conditions are governed by the laws of Tasmania. Any dispute shall be determined by a court of competent jurisdiction within Tasmania unless otherwise required by law.
13.4 Entire Agreement
These Terms & Conditions, together with the Booking Confirmation, constitute the entire agreement between the parties and replace all previous representations relating to the booking.
13.5 Amendments
Holiday Rental Hosting may amend these Terms & Conditions from time to time. The version in force at the time the booking is confirmed will apply to that booking unless otherwise required by law.
13.6 Electronic Acceptance
Payment of a booking deposit, completion of guest verification, or occupation of the Accommodation constitutes acceptance of these Terms & Conditions.
